Regarding the
Consumer Product Safety Improvement Act of 2008 (‘CPSIA’)
February 16, 2009
The CPSIA was signed into federal law in August, 2008. One of its purposes was to create more stringent product safety requirements regarding the manufacture, sale, and distribution of children’s products in the U.S. Some regulations are in effect now, and some become effective when they are phased in over the next several months and years.
Many of the provisions are not clearly defined within the Act and are somewhat ambiguous which has created a tremendous amount of controversy. Toy manufacturers and importers asked the Consumer Product Safety Commission (‘CPSC’) for guidance to clearly understand the safety provisions within the Act. The CPSC interpreted the Act to the best of their ability and published their opinions. Many activist groups felt the CPSC’s interpretation was incorrect and filed a lawsuit that overturned the CPSC’s opinion. This has been frustrating and has made things very difficult for everyone that is affected by the CPSIA. We can only expect that until Congress steps in to fix the mess they’ve created, more of the provisions that become effective over time will be interpreted in different ways and perhaps change drastically with little to no time for businesses to adequately adjust to those changes.
This Statement of Compliance was written to certify that L. M. Becker & Co., Inc. strictly adheres to the current and forthcoming regulations contained within the CPSIA as they evolve. Our Product Safety Compliance Department consists of a team of individuals who continually monitor these and other safety regulations on a daily basis, and advise and implement changes to the development, manufacturing, purchasing, production, sale, and shipping processes regarding the children’s products L. M. Becker & Co., Inc. provides. Three key individuals in this department are authorized to immediately apply corporate policy and procedural changes to adjust our business practices in a timely manner in order to always maintain adherence to, and compliance with any and all consumer product rules, bans, standards, or regulations, which are enforced by the CPSC at that given time. By granting them this authority, our corporation is able to quickly adapt and remain in full compliance with the law at all times.
In addition to this Statement of Compliance, we have General Conformity Certificates (‘GCC’) available for every child’s product we currently provide which references detailed compliance to the product safety standards that are applicable to the item.
